Good Morning

With regard to the above matters, I have learnt that Shepstone and Wylie hav=
e a similar matter. I spoke to the attorney dealing with the matter and he c=
onfirmed that they have such a matter and that an appeal is pending before t=
he Supreme Court of Appeal in their matter.

He has undertaken to furnish me with details of their matter. On receipt of t=
he details, I propose addressing a letter to Sars attorney=E2=80=99s in resp=
ect of the above matters and propose to them, that our matters be held in ab=
eyance pending the judgment of the SCA in the matter being dealt with by She=
pstone and Wylie. In the interim Advocate Van Der Merwe S C and I are workin=
g on our replying affidavit in respect of the interlocutory application, in t=
he event that Sars attorney=E2=80=99s do not agree to hold the matters=E2=80=
=99 in abeyance.

Inform clients=E2=80=99 accordingly.
